Canadian Judicial Citations of Articles Published in the University
of Toronto Faculty of Law Review
Patricia McMahon
ABSTRACT
This article and its appendices provide a citation history of the
University of Toronto Faculty of Law Review. The author seeks
to determine, on the occasion of the sixtieth anniversary of this unique
student publication, the impact that the Law Review has had on
legal debates in the courtroom. The author finds that articles in the
Law Review have been cited by all levels of court and across
a number of areas of law. Most often, articles used in judgments are
used to provide reference materials, further information, background
materials, or to support a particular line of argument. Law Review
articles have been cited by the judiciary alongside material published
by academics, lawyers, and other legal practitioners. Thus, to the extent
that any legal journal has been part of the development of Canadian
jurisprudence, the Law Review has been a significant contributor
to judicial reasoning and debate. The author concludes that this is
one of the greatest accomplishments of the Law Review.
