Using the Inter-American System and Pursue International Labour Rights:
A Case Study of the Guatemalan Maquiladoras

ABSTRACT
This article considers Guatemala's maquiladora or export-processing
industry in light of that country's international human rights obligations
within the Inter-American system. After outlining labour conditions
in the maquiladoras, the author examines whether violations of
labour rights are covered by the American Convention on Human Rights
and the American Declaration of the Rights and Duties of Man.
She then considers the possibility that states might be held responsible
for human rights violations by private actors. Finally, she discusses
whether economic rights in general, and labour rights in particular,
should be pursued within the Inter-American human rights system.
